Jacksonville Boat Charters is a registered fictitious name of Fourth Party Affiliates LLC, a Florida limited liability company.

1. Eligibility

You must be at least 18 years old to make a booking or use this website. If you are booking for a group, you confirm that all participants meet the required age and safety guidelines.

2. Bookings and Payments

• Booking requests are not confirmed until payment is received.
• We accept major credit cards and secure online payments.
• Pricing, availability, and services listed on the website are subject to change.
• A 15% gratuity is added to all charters with more than 6 passengers.
• A $50 per-charter premium charge applies on holidays and holiday weekends.

3. Cancellations and Refunds

Cancellations made more than 5 days before your trip are refundable, less a 3% processing fee. Cancellations made within 5 days of your trip are non-refundable. If Jacksonville Boat Charters cancels your charter for weather or safety reasons, you will be offered a full refund or the option to reschedule.

4. Use of Services

When you participate in a charter:

• You agree to follow all safety instructions provided by the captain and crew.
• You are responsible for all guests in your party.
• You must obey all applicable laws and maritime safety rules.
• The captain has final authority on all safety matters, including delaying or ending a charter.

5. Assumption of Risk

Boat charters involve inherent risks related to water activities and weather. By booking, you voluntarily assume these risks and agree that Jacksonville Boat Charters is not liable for injuries or losses arising from normal charter activities.

6. Limitation of Liability

To the fullest extent permitted by law, our liability for any claim related to our services or website is limited to the amount you paid for the charter.

7. Intellectual Property

All content on this website, including text, images, and graphics, is owned by or licensed to Jacksonville Boat Charters and may not be used without permission.

8. Modifications to These Terms

We may modify these Terms at any time. Continued use of the website or booking after changes are posted means you accept the updated Terms.

9. Governing Law

These Terms are governed by the laws of the State of Florida.

Program Sponsor

The SMS text messaging programs described below are operated by Jacksonville Boat Charters, a registered fictitious name of Fourth Party Affiliates LLC. All messages identify Jacksonville Boat Charters as the sender.

Program Descriptions

Jacksonville Boat Charters operates two separate SMS text messaging programs. You may join one, both, or neither. Consent for each program is collected separately and is always optional.

Program A — Customer Care and Booking Updates (Non-Marketing). Messages include booking confirmations, reservation reminders, captain and departure updates, dock location details, weather and safety notices, booking links you have requested, and two-way replies to your customer support questions.
Message frequency: Message frequency varies based on your booking activity and support requests.

Program B — Promotions and Offers (Marketing). Messages include seasonal charter offers and discounts, charter availability, and news about our fleet and departure locations.
Message frequency: Message frequency varies. You can expect approximately 2 to 4 marketing messages per month.

How to Join (Opt-In)

Jacksonville Boat Charters sends SMS text messages only to individuals who have given express written consent. We do not text purchased, rented, or borrowed contact lists. Consent is never implied by simply providing a phone number or submitting a form.

You may opt in by:

• Manually checking the applicable SMS consent box on our contact form at boatchartersjacksonville.com/contact-us. Consent boxes are not pre-checked, and checking them is optional and is not required in order to submit the form.
• Manually checking the optional SMS consent box during online booking checkout.
• Replying START to a message from Jacksonville Boat Charters after a previous opt-out.

You may opt out at any time by replying STOP to any message you receive from Jacksonville Boat Charters.

Consent Is Not a Condition of Purchase

Your consent to receive SMS text messages is not a condition of purchasing any product or service from Jacksonville Boat Charters. You may book a charter without agreeing to receive text messages.
